Copyright Dispute Policy (DMCA)

Guzagift strictly adheres to the Digital Millennium Copyright Act (DMCA) and related copyright regulations. We have established the following policy to address copyright infringement disputes. Accordingly, we reserve the right to:- Block access to or remove content that we believe in good faith has been illegally copied and distributed by our advertisers, affiliates, content providers, members, or users.
- Terminate service for repeat offenders.
Your use of Guzagift’s services is always subject to our Terms of Service, which incorporates this Copyright Dispute Policy. Any terms used in this policy without definition have the meanings provided in the Terms of Service.
Procedure for Reporting Copyright Infringement
If you believe that material or content hosted on or accessible through our services infringes your copyright (or the copyright of someone you are authorized to represent), please send a notice of copyright infringement to our Designated Agent (contact details provided below). Your notice must include the following information:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work(s) claimed to have been infringed.
- Identification of the infringing material, including details about its location, so that Guzagift can locate and verify its existence.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Your contact information, including address, phone number, and, if available, email address.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
Actions Taken Upon Receipt of a Valid Infringement Notice
Once a proper infringement notice is received by our Designated Agent, we reserve the right to:
- Remove or disable access to the infringing material.
- Notify the content provider accused of infringement that we have removed or disabled access to the material.
- Terminate the content provider’s access to our services if they are a repeat offender.
Procedure to Submit a Counter-Notice
If a content provider believes that the removed or disabled material is not infringing, or that they have the right to use the material (e.g., through permission or fair use), they may send a counter-notice to our Designated Agent. The counter-notice must include:
- A physical or electronic signature of the content provider.
- Identification of the material that was removed or disabled, along with its location before removal.
- A statement, under penalty of perjury, that the material was removed or disabled due to a mistake or misidentification.
- The content provider’s name, address, phone number, and, if available, email address.
- A statement consenting to the jurisdiction of the Federal Court for the judicial district where the content provider’s address is located (or, if outside the U.S., where Guzagift is located) and accepting service of process from the party who submitted the original infringement notice.
If a valid counter-notice is received, Guzagift may, at its discretion, send a copy to the original complainant. The removed material may be restored or access reinstated within 10 to 14 business days, unless the copyright owner files a court order against the content provider.
